Toby Caswell: First of all, if the title to the car was in your name, your mother could not have legally sold the car. So she sold it illegally. You would had to have signed over the title to the new owner. So your mother is in some serious legal trouble. There has to have been an accident report, so your mother can not hide what she did. And YOU are responsible for the accident. The car is still yours... it doesn't matter if that person gave your mother money. You own the car... period! You better still have insurance.This is so far fetched, I find it hard to even believe this story is true. Devon Kalberer: You will be sued. The buyer never registered the car in their name nor did they purchase insurance. Your mother should not be allowed to conduct business.
Clemente Schoe! ck: Tell the buyer that although you cannot prohibit the people from suing you and be included as a defendant. The buyer too would be sued since you were not the driver and if there is a lawsuit you will counter-sue to include the buyer as a party. Additionally, it was a grave error not to have removed your name or transfer the title. Anytime you sell a car you take the buyer to the DMV and transfer the title with the mileage on it. Never trust your mom again with any transaction and tell her to fix the mess she has created. If they are not responding to you, write to them, certified letter, return receipt requested....Show more
